Welcome to CatchLingo. These Terms of Service (the "Terms") are a legally binding agreement between you ("you" or the "User") and the provider of the CatchLingo mobile application ("CatchLingo", "we", "us", or "our"). By creating an account or otherwise using the CatchLingo app (the "Service"), you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility and acceptance
You may use the Service only if you are at least 13 years old (or the age of digital consent in your country, which may be higher) and are able to form a binding contract. If you are old enough to use the Service but under the age of majority in your country, your use must be with the involvement of a parent or guardian who agrees to these Terms on your behalf and is responsible for your activity.
2. The Service
CatchLingo is a mobile app that helps you learn foreign-language vocabulary by recognizing objects in the photos you take or choose. Using image recognition, image segmentation, and text-to-speech, the app identifies an object and shows you its name in your target language, with pronunciation and word cards. We may add, change, or remove features over time, and we will give you notice of material changes where appropriate.
3. Your account
- Accuracy. Provide truthful information when you register and keep it up to date.
- Security. You are responsible for keeping your sign-in credentials and your device secure, and for any activity that happens under your account. Your sign-in credentials are stored locally on your device. Tell us promptly if you suspect any unauthorized use of your account.
- One account per person. Your account is personal and may not be sold, transferred, or shared.
- Deleting your account. You can delete your account at any time in Settings → Data & Privacy. See our Privacy Policy for what happens to your data.
4. Credits, subscriptions, and payments
- Credits. Some features use "credits." You may receive free credits (for example, when you sign up or use the daily check-in), and you may buy credits or a subscription. Credits are a limited, non-exclusive, non-transferable license to use the Service and have no cash or monetary value.
- Subscription plans. A subscription gives you an ongoing monthly allocation of credits. Unused credits do not roll over to the next cycle. The specific allocation and price depend on the plan you choose, as shown in the app at the time of purchase.
- Purchases and billing. In-app purchases and subscriptions are billed by the Apple App Store or Google Play, depending on your device, and their own terms and refund policies apply. We do not see or store your full payment details.
- Renewal and cancellation. Subscriptions renew automatically until you cancel them. You can cancel at any time in your device's App Store / Google Play subscription settings, and you will keep access until the end of the current period.
- Important — deleting your account does not cancel your subscription. If you have an active paid subscription and you delete your CatchLingo account, your subscription is not cancelled automatically. To avoid being charged, you must cancel the subscription yourself in your Apple App Store or Google Play settings. We do not do this for you because, for your security, only you can authorize changes to your store subscriptions.
- Refunds. Refunds for App Store / Google Play purchases are handled by Apple/Google under their own policies. Credits and subscription entitlements are generally non-refundable, except where a refund is required by applicable law. Where the law requires a refund, we will honor it.
- Price changes. We may change prices from time to time. Any change to a price you have already agreed to will be communicated to you in advance, as required by law.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, fraudulent, or infringing purpose.
- Upload photos that contain illegal content, third-party copyrighted material you do not have rights to, or confidential/sensitive documents (such as IDs, passports, payment cards, medical or legal records), or photos of private individuals taken without their consent.
- Abuse, overload, attack, or disrupt the Service, or try to access it in ways we do not intend or authorize (for example, automated or bulk recognition, scraping, or bypassing usage limits).
- Reverse engineer, decompile, or disassemble the app, except to the limited extent (if any) that applicable law expressly prohibits this restriction.
- Circumvent any security, billing, or usage-limitation measure, or create accounts in bad faith.
- Use the Service to harm, harass, or mislead others.
We may suspend or restrict access if we believe you have violated these Terms or the law, and we may terminate accounts for serious or repeated violations. Where reasonably possible, we will give you notice and a chance to address the issue first.
Please be thoughtful about what you photograph. Do not upload images of identity documents, bank or payment cards, medical records, or other people's private information. You are responsible for the content you upload.
6. Your content
- Ownership. You keep ownership of the photos you upload.
- License to us. To provide the Service, you grant us a limited, worldwide, royalty-free license to process your photos solely to recognize objects, generate vocabulary and pronunciation, and produce the cards and results you request — and then to delete that content as described in our Privacy Policy. This license ends when the content is deleted after your task. We do not use your photos to train AI models or for marketing.
- Responsibility. You are responsible for making sure you have the rights to upload your photos and that doing so does not break the law or anyone else's rights.
7. Intellectual property
- The Service. CatchLingo, the app, our software, designs, logos, and other Service content are owned by us or our licensors and are protected by intellectual-property laws. Nothing in these Terms gives you any rights to our trademarks or service marks.
- Your generated content. The word lists, pronunciations, and cards you create may be used for your own personal, non-commercial learning. We grant you a limited license to use them for that purpose. Please do not resell or redistribute the Service's outputs as a competing product.
8. Disclaimers
The Service is provided "as is" and "as available," to the extent permitted by applicable law. AI image recognition can be inaccurate, and results are for learning purposes only — please verify anything important on your own, and do not rely on recognition results for safety, medical, legal, or other critical decisions. We do not promise that the Service will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the maximum extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or relating to the Service. Our total liability for any claim is limited to the amount you have paid us through the Service in the twelve (12) months before the event giving rise to the claim (or, if you have not paid anything, to a reasonable minimum amount set by applicable law).
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law — for example, liability for gross negligence or willful misconduct, or the mandatory consumer-protection rights you have in your country.
10. Indemnity
To the extent permitted by law, you agree to indemnify and hold us harmless from claims, damages, and expenses that arise from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right in connection with content you upload.
11. Term and termination
These Terms begin when you start using the Service and continue until terminated. You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if your account stays inactive for an extended period (we will try to notify you first), or if we discontinue the Service, and we may do so immediately for serious violations. When these Terms end, your right to use the Service ends, and we will delete your data as described in the Privacy Policy.
12. Third-party services
The Service relies on third parties, including Apple, Google, RevenueCat, Firebase, Alibaba Cloud, Microsoft Azure, Cloudflare, and Resend. Their terms and policies may also apply to you, and we are not responsible for their conduct or for issues outside our control, except where applicable law says otherwise.
13. Changes to these Terms
We may update these Terms. We will notify you in the app about material changes. Your continued use of the Service after a change takes effect means you accept the updated Terms, to the extent permitted by law.
14. Governing law and disputes
These Terms and your use of the Service are governed, to the extent permitted by applicable law, by the laws of the country or region in which you reside. Nothing in these Terms reduces any mandatory rights you may have under the consumer-protection and data-protection laws of your country of residence.
If a dispute arises, we will first try to resolve it with you informally — please contact us using the details in Section 16. If we cannot resolve it that way, it will be handled by the courts that have jurisdiction, and you may also bring a claim in the courts of the country or region where you live, where local law gives you that right.
15. General
If any part of these Terms is found to be unenforceable, the rest will remain in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, sale of assets, or otherwise. Our failure to enforce a right is not a waiver. These Terms are the entire agreement between you and us about the Service.
