Welcome to CatchLingo. These Terms of Service (the "Terms") are a legally binding agreement between you ("you" or the "User") and the provider of the CatchLingo mobile application ("CatchLingo", "we", "us", or "our"). By creating an account or otherwise using the CatchLingo app (the "Service"), you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility and acceptance
The Service is not designated for children and is not addressed to anyone under the age of 13 (or a higher age where local law requires). Our Privacy Policy explains how we handle children's information.
2. The Service
CatchLingo is a mobile app that helps you learn vocabulary in your selected language by recognizing objects in the photos you take in the app or select from your photo library. Using image recognition, image segmentation, and text-to-speech, the app identifies an object and shows you its name in your target language, along with related information such as associated words and example usage, pronunciation, and Lingo stickers you can collect. We may add, change, or remove features over time, and we will give you notice of material changes where appropriate.
3. Your account
- Accuracy. Provide truthful information when you register and keep it up to date.
- Security. You are responsible for keeping your sign-in credentials and your device secure, and for any activity that happens under your account. Your sign-in credentials are stored locally on your device. Tell us promptly if you suspect any unauthorized use of your account.
- One account per person. Your account is personal and may not be sold, transferred, or shared.
- Deleting your account. You can delete your account at any time in Settings → Data & Privacy. See our Privacy Policy for what happens to your data.
4. Credits, subscriptions, and payments
- Monthly credits and expiry. While your subscription is active, credits are issued monthly, and the previous month's credits expire. Credits you receive for free (for example, through rewards or daily check-in) expire as shown in the app, and we may adjust these expiry rules.
- Renewal and cancellation. Subscriptions renew automatically until you cancel them. You can cancel at any time in your device's App Store / Google Play subscription settings, and you will keep access until the end of the current period.
- Important — deleting your account does not cancel your subscription. If you have an active paid subscription and you delete your CatchLingo account, your subscription is not cancelled automatically. To avoid being charged, you must cancel the subscription yourself in your Apple App Store or Google Play settings. We do not do this for you because, for your security, only you can authorize changes to your store subscriptions.
- Refunds. Credits and subscription entitlements are generally non-refundable, except where a refund is required by applicable law. Where the law requires a refund, we will honor it.
- Price changes. We may change prices from time to time. Any change to a price you have already agreed to will be communicated to you in advance, as required by law.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, fraudulent, or infringing purpose.
- Upload photos that contain illegal content, third-party copyrighted material you do not have rights to, or confidential/sensitive documents (such as IDs, passports, payment cards, medical or legal records), or photos of private individuals taken without their consent.
- Abuse, overload, attack, or disrupt the Service, or try to access it in ways we do not intend or authorize (for example, automated or bulk recognition, scraping, or bypassing usage limits).
- Reverse engineer, decompile, or disassemble the app, except to the limited extent (if any) that applicable law expressly prohibits this restriction.
- Circumvent any security, billing, or usage-limitation measure, or create accounts in bad faith.
- Use the Service to harm, harass, or mislead others.
We may suspend or restrict access if we believe you have violated these Terms or the law, and we may terminate accounts for serious or repeated violations. Where reasonably possible, we will give you notice and a chance to address the issue first.
Fair use. Credits and the Service are intended for normal, personal use by real people. To keep the Service fair and affordable for everyone, we monitor usage patterns and may limit, suspend, or terminate accounts that show automated, scripted, bulk, or otherwise abusive activity.
Please be thoughtful about what you photograph. Do not upload images of identity documents, bank or payment cards, medical records, or other people's private information. You are responsible for the content you upload.
6. Your content
- Ownership and storage. You keep ownership of the photos you take in the app or select from your photo library. They are stored on your device; when you request recognition, a copy is sent to us only to be processed and is deleted immediately afterwards, as described in our Privacy Policy.
- License to us. To provide the Service, you grant us a limited, worldwide, royalty-free license to process your photos solely to recognize objects, generate vocabulary and pronunciation, and produce the Lingo stickers and results you request — and then to delete that content as described in our Privacy Policy. This license ends when the content is deleted after your task. We do not use your photos to train AI models or for marketing.
- Responsibility. You are responsible for making sure you have the rights to upload your photos and that doing so does not break the law or anyone else's rights.
7. Intellectual property
- The Service. CatchLingo, the app, our software, designs, logos, and other Service content are owned by us or our licensors and are protected by intellectual-property laws.
8. Disclaimers
The Service and its AI-generated outputs (such as object recognition, translations, pronunciations, and Lingo stickers) are provided "as is" and "as available," to the extent permitted by applicable law. AI-generated content may contain errors or incorrect identifications, and is for general reference and learning only — it is not professional, medical, legal, safety, or educational advice. Use your own judgment, verify anything important independently, and do not rely on the Service for decisions that could affect safety, health, rights, or property. You are solely responsible for how you use the Service and its outputs. To the extent permitted by applicable law, we disclaim all warranties, express or implied, including those of merchantability, fitness for a particular purpose, accuracy, and non-infringement, and we do not promise that the Service will be uninterrupted, accurate, error-free, or secure.
9. Limitation of liability
To the maximum extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or relating to the Service. Our total liability for any claim is limited to the amount you have paid us for the Service (for example, your subscription fees) during the twelve (12) months before the event giving rise to the claim. If you have not paid us anything, our liability is limited to a nominal amount, to the maximum extent permitted by applicable law.
10. Indemnity
To the extent permitted by law, you agree to indemnify and hold us harmless from claims, damages, and expenses that arise from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right in connection with content you upload.
11. Term and termination
These Terms begin when you start using the Service and continue until terminated. You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if your account stays inactive for an extended period (we will try to notify you first), or if we discontinue the Service, and we may do so immediately for serious violations. When these Terms end, your right to use the Service ends, and we will delete your data as described in the Privacy Policy.
12. Changes to these Terms
We may update these Terms. We will notify you in the app about material changes. Your continued use of the Service after a change takes effect means you accept the updated Terms, to the extent permitted by law.
13. Disputes
If a dispute arises, we will first try to resolve it with you informally — please contact us using the details in Section 15. If we cannot resolve it that way, the dispute will be exclusively submitted to the jurisdiction of the competent courts of mainland China, and you agree to bring any claim arising out of or relating to these Terms or the Service before those courts.
14. General
If any part of these Terms is found to be unenforceable, the rest will remain in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, sale of assets, or otherwise. Our failure to enforce a right is not a waiver. These Terms are the entire agreement between you and us about the Service.
